Inadmissibility

Normally, if you’re inadmissible to Canada, you won’t be allowed to enter the country. There are different reasons you may not be allowed into Canada, such as security, criminal, medical reasons, or misrepresentation. With some exceptions, you can also be found inadmissible to Canada if you have an inadmissible family member.

Criminal Inadmissibility

You might be inadmissible on grounds of criminality for committing or been convicted of an indictable crime or two offences not arising out of a single occurrence, or committing a crime upon entering Canada (in or outside of Canada).

Misrepresentation

Misrepresentation occurs when information is provided to Immigration, Refugees and Citizenship Canada (IRCC) or to the Canada Border Services Agency (CBSA) that is inconsistent, inaccurate, or incomplete.

Authorization to Return (ARC)

If you have been the subject of a removal order from Canada, you will probably need an Authorization to Return to Canada (ARC) if you want to return.

In the following circumstances, you may be issued a removal order:

  • The Immigration Division (ID) or Immigration Appeal Division (IAD) determines that a Removal Order should be issued after a hearing, and issues an Order
  • A Canada Border Services Agency (CBSA) Officer issues a Removal Order after an examination
  • An individual submits a refugee claim, and so receives a conditional Removal Order that will come into effect shortly after the refusal of the refugee claim

In most cases, you can overcome inadmissibility. It is strongly recommended to get advice or representation from a professional.
